T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service

SERVICE AGREEMENT

1. Overview. Client, identified by signature below, enters this agreement with T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service, its agents, affiliates, contractors, assistants, and/or associates, hereinafter referred to as T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service. The contents of this agreement apply to the initial period of time during which services will be rendered, hereinafter referred to as "Service Period," as well as to any subsequent service periods in the future. Details of the services to be provided are expressed separately: in writing, orally, or both, and may be changed from time to time upon client’s notification and T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service subsequent acknowledgement and agreement. Costs of services are based upon T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service published rates and fees, which are available for Client’s review, and subject to change without notice.

2. Food and supplies. Client agrees to ensure that an adequate amount of food and/or other supplies are available, obtainable, in good condition, and in a location that T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service can easily locate in the home prior to commencement of the Service Period and for the duration of the entire Service Period, and that depletion of such food and/or other supplies would result in T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service replenishment with the same or a reasonable substitute in any quantity at Client’s expense, plus applicable errand surcharges.

3. Client’s return. Client agrees to contact T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service by telephone immediately upon return to the home — whether early, on time, or late — to check in and formally close the Service Period. If Client fails to contact T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service immediately upon return, Service Period may be extended as detailed below under "Extension of service period" and may result in additional charges.

4. Extension of service period. In the event of a delay in the Client’s return, Client must contact T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service by telephone at Client’s earliest opportunity. Service Period may be extended by mutual agreement between T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service and Client by telephone. In case of international travel, cruise ship travel, or emergency situations, in which a telephone call to The Paw Pleaser is not possible or practical, T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service may extend Service Period to accommodate the needs of the animals, plants, and home, for a maximum of seventy-two (72) hours. If no contact is made to T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service within seventy two (72) hours, T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service reserves the right to surrender keys to the home and the care of its animal inhabitants to an Emergency Contact specified in the Client Profile, at which point the Service Period closes.

5. Security systems. If Client’s home is equipped with a burglar alarm or other type of security system, client agrees to provide sufficient instructions to T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service to arm and disarm the system. If during the Service Period a security system generates a false alarm that dispatches emergency personnel, or if the system fails to generate an alarm under legitimate circumstances, T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service is not liable for any charges, fines, or other damages resulting from the malfunction, even if it is evident that T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service is wholly or partially responsible for the malfunction.

6. Client’s key(s). T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service safeguards Client’s key(s) by tagging and coding key(s) in a manner that offers reasonable protection to Client in the event of loss or theft of key(s). Following the Service Period, T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service securely retains Client’s key(s), at no additional charge, for safekeeping until (a) client wishes to engage T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service services in the future or (b) client contacts T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service to arrange repossession of key(s). T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service will only return key(s) via (a) personal delivery to Client or Client’s authorized representative (for which an additional charge may apply) or (b) via Registered US Mail (for which an additional charge may apply). T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service will not leave key(s) unattended at Client’s home.

7. Property damage. While T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service insurance policy may cover damage to Client’s property that T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service causes by accident or neglect, T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service is not responsible for damage to Client’s property caused by Client’s pets during the service period. If any neighbor, friend, family member, contractor, or other Client representative enters Client’s home or property during a Service Period, T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service is not responsible for damages or loss to Client’s property.

8. Personal injury. Client assumes responsibility for injuries and disabilities sustained by T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service caused by Client’s pets and/or home, including but not limited to bites, scratches, mauls, trip hazards, obstructions, etc. T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service does not provide service for aggressive animals. If Client misrepresents an animal’s history of aggression, Client places T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service at substantial risk and may be liable for significant punitive damages. If any of Client’s pets exhibits signs or acts of aggression after Client enters this agreement, Client is obligated to notify T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service of the incident(s) (a) at once if a Service Period is pending, or (b) upon requesting future service. T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service decision to provide care to an animal(s) following Client disclosure of unsatisfactory animal behavior does not indemnify Client from claims resulting from such animal(s). If The Paw Pleaser takes pet(s) off Client’s premises, Client agrees to indemnify and hold harmless T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service for any injury or damage which may be caused to others by the actions of Client’s pet(s), or to Client’s pet(s) caused by the actions of other animals, including but not limited to loose or stray dogs. 9. Plant care. If Client requests plant care and plants die or are damaged during a Service Period, T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service is not responsible.10. Outdoor animals. If Client’s pets have access to outdoors, T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service is not responsible for injury, disappearance, or death of pet(s) with said access.

11. Pets without ID collars. T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service strongly encourages its clients to maintain legible and accurate ID collars on cats and dogs, even if they are not provided unleashed access to the outdoors. If Client has pets without proper identification, T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service is not responsible for their disappearance.

12. Urgent animal care. In case of an illness or injury that T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service believes to threaten Client’s pets’ lives or quality of life, T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service will make every reasonable attempt to secure prompt treatment for Client’s pets. Client authorizes T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service to authorize emergency first aid and/or medical/surgical treatment to Client’s pets at a veterinary clinic of T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service choice during the Service Period, and Client agrees to be solely responsible for all expenses incurred resulting from such effort, even if unsuccessful, up to limits designated in writing, or if not available, at T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service discretion. Due to the nature and urgency of some types of pet health emergencies where time is of the essence, there may not be time to consult with Client or Client’s specified emergency contact(s) before action is taken; however, T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service will make every reasonable effort to reach Client and/or Client’s specified emergency contact(s) when T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service considers it safe and/or appropriate to do so. In the event that T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service believes that Client’s pet(s) may have ingested a toxic or dangerous substance, Client authorizes T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service to consult the services of an Animal Poison Control Center at Client’s expense. 13. Urgent home care. In the event that Client’s home is damaged during the Service Period, and if T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service determines that the damage causes the property to be unsafe, insecure, or subject to further damage or loss without proper attention and/or repair, T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service will first attempt contact with Client and/or Emergency Contact(s) to establish plan of action, and if neither Client nor Emergency Contacts can be reached, Client authorizes T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service to take appropriate steps to return the property to a safe, secure, and/or stable condition at Client’s expense. Examples of such urgent home care include but are not limited to window breakage, water damage due to plumbing problems, forced entry, tree limb damage, vehicle damage, etc.

14. Discretionary license. If T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service determines at its sole discretion that it is unsafe to enter Client’s property and/or approach Client’s pets, if damages or injuries occur during the Service Period, or if T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service discovers Client’s misstatements or omissions of fact that are significant, T Wheat's Paw-2-Purr-Fect Pet & House Sitting Service reserves the right to close the Service Period prior to its scheduled closure and/or secure one or more pets in any manner necessary, including but not limited to crating, tethering, confining, off-site boarding, off-site kenneling, or off-site sheltering, at Client’s expense. 15. Death of pet(s). Client acknowledges that there is always the possibility of death of Client’s pets during the Service Period. In the event of the death of Client’s pet(s), Client authorizes the transport of the pet(s) to any available veterinary office/hospital for autopsy and cremation at Client’s expense, unless Client specifies otherwise in writing.

16. Attorneys’ Fees. If a legal proceeding is commenced to enforce or obtain a declaration of rights under this Agreement, the prevailing party in such proceeding shall be entitled to recover its reasonable attorneys’ fees and costs incurred in the proceeding from the non-prevailing party, as well as any reasonable attorneys’ fees and costs that the prevailing party incurred prior to commencing the proceeding.

17. Payment terms. Payment for 100% of services is due when services are contracted. Payment may be made by cash or check . Credit & debit card with the Mastercard & Visa logo are accepted with a 2.90% fee plus a .30 cent processing fee to be added to the service. The Client acknowledges the Price List and that prices may change without notice. The Client acknowledges that cancellation charges may apply. Returned checks are subject to a $25 handling charge, and may result in cash or cash equivalent payment being required (a) in advance for future services and/or (b) to settle an existing outstanding balance.

I have READ, UNDERSTAND, AND AGREE to all terms and conditions specified above and acknowledge that I have been provided a legible copy of this document.
